Application for a temporary structure or occupation of road reserve

An application for a temporary structure or occupation of road reserve is required when there is plan to occupy Council's road reserve on a temporary basis. This includes where a storage compound, hoarding type A, B or C, crane or platform, ground anchors or shipping container are placed on the Council's road or verge.

For skip bin placements on the footpath or road, you should contact a Council registered Bulk Waste Container (BWC) or skip bin supplier to arrange for the bin to be placed on Council controlled land - these applications cannot be made directly by residents.

For driveway construction, minor utility installation (stormwater to road/boreholes/connection of services in verge or road) you will need to submit a minor public works application.

Step 1.Gather your documents

Approval to use road reserve to place a hoarding, scaffolding, facade retention, shoring, site sheds, ground anchors, clothing bin, crane lift or other temporary structure, is made under Section 138 of the Roads Act 1993.

As part of this application you will need to provide the following details:

  • Diagram or plan showing the location, type and length of work proposed. If the work involves overhead protective structures or ground anchors you must provide a structural engineers certificate endorsing the drawings and engineering details supplied. Drawings must comply with relevant current codes of practice of the NSW Work Cover Authority, relevant clauses of Building Code of Australia and Australian Standard, including sketch or plans.
  • Evidence of adequate public liability insurance for $20,000,000.00

If the work involves traffic control you must provide:

  • Certificate of Currency for workers compensation insurance covering the period of the planned traffic management.
  • A Traffic Control Plan developed by a qualified and licenced professional detailing layout of temporary signs and devices showing the traffic management arrangement.

Step 2.Pay

Fees will be calculated by Council staff and provided to you in writing after we've received your application.

Step 3.Apply

Once you have gathered your documents, you can apply online for a temporary structure or occupation of road reserve approval.  You'll need to upload electronic versions of the required documentation in order to complete your application.
