Under the Protection of the Environment Operations (Underground Petroleum Storage System) Regulation 2019, local councils have the responsibility for regulating Underground Petroleum Storage Systems (UPSS). UPSSs are generally located at service stations throughout the local government area. Under the regulation, councils are the Appropriate Regulatory Authority and can conduct site visits requesting compliance information.
As part of Council’s commitment to ensuring healthy environments, we will be inspecting all UPSS sites to ensure compliance in order to protect the health of the environment and the public.
Notification of a pollution incident to the relevant authority under Part 5.7 of the Protection of the Environment Operations Act 1997 (PEOE).
The person responsible for the UPSS must, immediately after becoming aware of a pollution incident, notify Council. Where the notification was verbal, a written notification using this form must be submitted within seven days. The person responsible is the person who has the management and control of the UPSS.
