You may seek to surrender your development consent in accordance with Section 4.17 or 4.63 of the Environmental Planning and Assessment Act 1979.
Surrendering the consent means that the development can no longer proceed. Any works which have been undertaken must be to the satisfaction of Council and no further works can take place.
In order to surrender a development consent, you must ensure the following:
No fees will be refunded given the development application has already been determined.
If works commenced and Council was appointed as the certifying authority, you may be eligible for part refund of fees, associated with the Construction Certificate.
If contribution fees have been paid and you are seeking to have these fees refunded, please note the contribution fees can only be refunded to the person who has benefit of the consent.
